Waiver and Release of Liability Form Acknowledgment and Acceptance of Risks: I hereby acknowledge that I have read, understood, and fully agree to all the terms and conditions set forth in this Waiver and Release of Liability Form. This includes the Warning, Liability Release, Indemnity Agreement, and Assumption of Risk. Equipment Responsibility: I accept full financial responsibility for the equipment listed on this form. I agree to return it in a clean and undamaged condition by the specified time and date. Should I fail to return the equipment as agreed, I accept the charges necessary for its repair, cleaning, or replacement at the full rental or retail value as determined by the provider. Additionally, I agree to pay for the rental value of any additional days required to restore the equipment. Safety and Instructions: I confirm that I have received comprehensive instructions on how to use the equipment and am satisfied with the explanations provided. I understand the operational procedures of the equipment. Should the equipment appear to be malfunctioning, I will cease its use immediately and return it for inspection, and if necessary, repair or replacement. Assumption of Risk for Ocean-Related Activities: I understand that activities such as surfing, swimming, bodyboarding, and other ocean-related activities are inherently hazardous. I acknowledge that injuries are common and ordinary occurrences during these activities. By signing this form, I assume all risks associated with these activities. Agreement to the Terms: By signing below, I agree to release, indemnify, and hold harmless the equipment provider, its employees, agents, and affiliates from any claims, damages, or liabilities arising from or related to my use of the equipment. I confirm my understanding that this waiver and release is binding upon my heirs, executors, administrators, and assigns. Acknowledgment of Risks and Equipment Use: I acknowledge that Blown Out Surf Shack is providing bicycles, surfboards, bodyboards, and wetsuits for my use. I understand that the leash binding on surfboards and bodyboards is designed to release under certain conditions and cannot prevent all injuries or guarantee my safety. I recognize the inherent risks of bicycle riding and that compliance with road rules cannot eliminate the possibility of injury or death. Risk of Injury: I further acknowledge that the use of helmets, wetsuits, surfboards, bodyboards, or swim fins does not eliminate the risk of injuries. I understand these risks extend to any physical harm that might occur during the use of such equipment. Release and Indemnity Agreement: To the fullest extent permitted by law, I hereby release and forever discharge Blown Out Surf Shack and all related parties—including manufacturers, distributors, sellers, renters, servicers, and inspectors of the equipment (collectively referred to as the "Released Parties")—from any and all responsibility or legal liability. This release covers all claims of injuries, damages, or death I may suffer, whether caused by negligence or any other cause. I agree not to sue the Released Parties for any such incidents and further commit to defend and indemnify the Released Parties against any claims or actions arising from any injuries, damages, or death that may occur as a result of my use of the equipment. This indemnification includes claims made by third parties and is binding upon my estate, heirs, and assigns. Understanding and Agreement: By signing this form, I confirm my understanding of the risks and my acceptance of these terms, which is intended to provide a comprehensive release of liability in favor of the Released Parties associated with my use of the provided equipment.
